Use of the Website a) for the purpose of purchasing by users (the "Users") Dermaself skin care and beauty products for sale on the Website (the "Products") b) or alternatively, for the purposes of accessing specialist medical support (“Medical Support”), which forms the object of the contract between the User and Dermaself (the “Contract”) is governed by these general conditions of use and sale (the "General Conditions").
By using the Website, the User can purchase personalized Products, prepared by Dermaself and can access specialized medical support based on the information provided by the User regarding - among other things - the characteristics of his/her skin, his/her age and his/her lifestyle (the "Service")
Support is provided by qualified personnel (the "Skin Specialists" and/or "Doctors," i.e., specialized doctors registered with local professional associations). Before using the Website and/or purchasing the Products, the User is required to carefully read these General Conditions, as well as the Privacy Policy and Cookie Policy referred to in Article 17 below.
SCOPE OF APPLICATION These General Conditions apply to the User's use of the Website as well as to the Contract concluded between the User and Dermaself. The methods of acceptance by the User of these General Conditions are regulated by the following paragraph 2.
REGISTRATION AND USE OF THE WEBSITE To use the Website, the User must create a personal account by registering on the Website and providing the requested information. Registration and, in general, use of the Website are permitted only to legal entities, partnerships, and individuals who are at least 14 years of age. A single User is not permitted to create multiple accounts, use other Users' accounts, or have their own accounts used by others. Upon registration, the User is asked to provide, under their sole responsibility, certain information necessary to create an account and allow Dermaself to prepare the Products, such as, but not limited to, name, surname, date of birth, email address, telephone number, payment information, skin characteristics, age, and lifestyle. The User is responsible for providing accurate and complete information and updating it as necessary. Once the required information has been entered in the appropriate fields on the registration form and the boxes indicating acknowledgement and acceptance of these General Terms and Conditions and consent to the processing of personal data have been checked, the User completes the registration by clicking the relevant button. Dermaself confirms registration by sending an email containing these General Terms and Conditions and the Privacy Policy. Individuals between the ages of 14 and 18 (the "Minor") will be required to provide a parent's email address. The parent will receive a request to authorize the opening of the Minor's account at that email address. Only if the parent authorizes the opening of the Minor's account as above (and provides the privacy consent indicated therein) will the registration process be successfully completed. Once the registration process is successfully completed, a personal account is created. To access the personal account and use the Website, the User must enter the username and password chosen during registration in the appropriate fields. The User is responsible for maintaining the confidentiality of his or her account login credentials and not disclosing them to third parties. Once logged in, the User can use the Service made available and, if applicable, conclude a Contract. Dermaself reserves the right to cancel certain accounts without giving reasons and to block access to the Website and accounts by Users at its sole discretion. Dermaself also reserves the right to modify or eliminate certain functions of the Website or to integrate new ones and/or to guarantee the use of the functions only in the presence of particular conditions.
PRODUCTS AND INGREDIENTS Each Product is described on the Website in the specific technical data sheet as finalized following the customization process (the "Technical Data Sheet"). The ingredients listed in the Technical Data Sheet are purely indicative. The list of ingredients indicated in the Technical Data Sheet is not an INCI list, as it is also indicative and not exhaustive. Extracts of these ingredients are used in the Products to offer a higher quality and higher performance Product. The INCI list is displayed only before making the purchase. It is the User's responsibility to carefully check the INCI list of the Product they are purchasing for the presence of any unwanted ingredients before completing the purchase. Dermaself declines all responsibility for any problems arising from the use of the Products and caused by intolerances and allergies not reported before purchase or within 30 (thirty) minutes of purchase. Any reactions caused by unreported intolerances and allergies cannot justify a refund/cancellation request. Dermaself reserves the right to modify the type or availability of Products on the Website at its sole discretion, as well as to adjust the technical and dimensional information of the Products and their packaging even without specific notice. The images of the Products shown on the Website are purely indicative. Dermaself reserves the right to change the ingredients at any time with others of equal or higher quality.
SPECIALIZED MEDICAL SUPPORT Specialized medical support allows the User to book an appointment online with a specialized doctor registered with the Medical Association of the area in which they practice. The profile of each specialized doctor is described on the Website in their specific professional profile. Dermaself declines all responsibility for any problems arising from medical advice offered to the User since the Website is a platform that simplifies the User's access to professionals in the field of medical care but is not a medical center, a polyclinic, a nursing home, or a medical clinic. Dermaself reserves the right to change the medical support staff even without specific notice.
CONCLUSION OF THE CONTRACT Order Process. The User may purchase all Products marked with a purchase button and all specialized medical supplies available on the Website. Before purchasing, the User confirms that he or she is legally capable of entering into binding contracts, that he or she is not purchasing Products for resale, and that he or she has read all the information contained in the Technical Data Sheet. By clicking the purchase button and completing the payment process, the User places a purchase order (the "Order") for the Product from Dermaself and/or specialized medical supplies. The Order will be considered accepted, and therefore the Contract concluded, only upon receipt by the User of a specific Order confirmation at the email address provided during registration.
Purchase in subscription mode. Users may also choose to purchase Products and/or specialized medical support on a subscription basis (the "Subscription"). By subscribing to one or more Subscriptions, Users will have access to a reserved area in their personal account where they can continuously manage their Subscriptions and receive priority email support regarding the Service, with a response time of no more than 2 (two) business days from the time the support request is sent to hello@dermaself.it. Users may modify the Products covered by their Subscription by following the procedure described in their personal account. The Subscription is automatically renewed each month without the need for notification from Dermaself. The Subscription may be deactivated at any time before the next renewal by making a request in the relevant section of the User account or by sending an email to hello@dermaself.it. Purchases made under the Subscription are non-refundable. Deleting your personal account from the Website does not deactivate your Subscription. You must first deactivate your Subscription and then delete your personal account. The compatibility of your Subscription with other offers or ongoing promotions is specified each time, if applicable. Discounts related to temporary promotions apply only once, upon activation of recurring delivery, but do not apply to subsequent renewals. Dermaself reserves the right to modify the discounts and benefits offered by the Subscription option at any time.
FEES AND PAYMENT METHODS All prices displayed on the Website are inclusive of VAT and may be changed at any time by Dermaself until the Contract is concluded with the User. The invoice for the purchase of the Product will be issued and sent to the User at the same time as the payment for the purchase itself [and can be downloaded by the User in the reserved area of his/her personal account]. The invoice for specialized medical care will be issued and sent to the User by the doctor following the specialist visit. In this case, the following procedure will apply: (i) payment will be made by the User via the Website; (ii) the Website issues an Order for booking specialized medical care; (iii) the online specialist visit will be conducted within XXX hours; (iv) the doctor receives payment for the invoice from Dermaself, which received payment via the Website. To pay for any Product purchased by the User via the Website, only the following payment methods may be used: Credit card, PayPal and, exclusively for purchases made in Subscription mode, also Stripe. If the User chooses to purchase under Subscription mode, the User may choose the preferred payment frequency (monthly, quarterly, semi-annually). In this case, the User authorizes Dermaself to charge the amounts of the Products purchased for the current Order and for all subsequent renewals, for an indefinite period, to the payment method indicated during the Initial Order. Fees already paid will not be refundable.
PAYMENT SECURITY Dermaself will use all reasonable efforts to ensure the confidentiality and security of the data and information shared by the User, to purchase the Products and/or in any case to access the Service, processed through the Website. The User declares to be aware that the available payment methods are offered and managed by third parties and that Dermaself is not responsible – for any reason, title or cause – for any damages suffered by the User as a result of their malfunction or fraud or other prejudicial events occurring during their use. All information and data required for the transaction will be transmitted via encrypted protocol to the payment management system that provides the relevant remote electronic payment services, without third parties having access to it. Dermaself will never use this information except to complete the procedures inherent to the use of the Website or when necessary to prevent or report fraud to the police on (or through) the Website.
CHANGES Any request to modify an Order must be received no later than 24 hours after the date the Order is placed at hello@dermaself.it. Dermaself will do everything possible to, but will have no obligation to, apply the requested changes to the Order.
SATISFIED OR REFORMULATED Pursuant to Article 59, paragraph 1, letters c), d), and e), of the Consumer Code, the right of withdrawal is excluded. However, Dermaself cares about customer satisfaction and has therefore voluntarily adopted a "Satisfied or Reformed" policy.
DELIVERY AND SHIPPING Dermaself processes and ships the Ordered Products within 5 (five) to 10 (ten) business days. If the ingredients intended to compose the Product are unavailable, Dermaself reserves the right to delay shipment of the Ordered Products by up to 14 (fourteen) business days. For multiple orders placed separately with the same shipping address, a single shipment may be made. Specific shipping requirements must be communicated by the User to hello@dermaself.it within 24 (twenty-four) hours of the Order confirmation date. The shipping boxes for the Products serve as packaging to protect the Products during transport. These cannot be subject to complaints and/or replacements. Dermaself reserves the right to choose the type of packaging to use to protect the Products during transport. Upon delivery of the Products, the User must verify the integrity of the packages and their quantitative and qualitative consistency with the information indicated in the order confirmation or delivery note. Any discrepancies must be noted on the accompanying document or courier's delivery note upon delivery. Any defects/anomalies must be promptly reported to Dermaself by email to hello@dermaself.it. Even if the packaging is intact, the Products must be inspected within 8 (eight) days of receipt. Any hidden Product anomalies must be reported in writing by email to hello@dermaself.it. Any reports received after the aforementioned deadlines will not be considered.
COMPLAINTS The User may submit any complaints to Dermaself at the email address: hello@dermaself.it.
DERMASELF'S RESPONSIBILITY Dermaself undertakes to do everything in its power to ensure uninterrupted access to the Service. However, due to the very nature of the Internet, uninterrupted access and the absence of errors in data transmission cannot be guaranteed. Furthermore, the User's access to the Service may also be occasionally suspended or limited to allow for maintenance, including development, of the Website. Dermaself will, in any case, attempt to limit the frequency and duration of such suspensions and limitations. Dermaself is not responsible for any delay or failure to fulfill its obligations under these General Conditions if the delay or failure results from unforeseeable circumstances or force majeure, except in cases of fraud or gross negligence. Except in cases of intent or gross negligence, any liability of Dermaself for indirect or consequential damages is expressly excluded.
LICENSE FOR ACCESS TO THE SERVICE Provided that the User complies with these Terms and Conditions, Dermaself grants the User a limited, non-exclusive, non-transferable, and non-sublicensable license to access and make personal, non-commercial use of the Service. You may not reproduce, duplicate, copy, sell, resell, or otherwise exploit the Service for any commercial purpose, in whole or in part, without the express written consent of Dermaself. You may not frame, reverse engineer, or otherwise utilize framing techniques to enclose any Dermaself trademark, logo, know-how, or other proprietary information (including images, text, page layout, or form) without the express written consent of Dermaself. You may not use any meta tags or any other "hidden text" utilizing Dermaself's name or trademarks without the express written consent of Dermaself. You may use the Service only as permitted by law and/or the contract. Without prejudice to any broader claim for damages, violation of these Terms and Conditions will result in the revocation of the license granted by Dermaself and the deactivation of your Account.
USER OBLIGATIONS AND RESPONSIBILITIES By accepting the General Conditions, the User undertakes to: use the Website in compliance with applicable laws and regulations, as in force from time to time, and in compliance with the rights of Dermaself and third parties, scrupulously adhering to the General Conditions and any technical instructions for use provided by Dermaself; ensure that the Service is used only by the User; not to disclose, directly or indirectly, your access credentials to the Website, thus preventing them from being used improperly or unduly and in any case remaining responsible for any use thereof; not take any action that could compromise the security of systems and/or devices to which the User has access via the Website.
ILLEGAL OR UNAUTHORIZED USE Dermaself reserves the right to suspend or limit the use of the Website if it has reasonable grounds to believe that it is being used by unauthorized third parties or if it has reasonable grounds to believe that the Service is being used illicitly and/or illegally by the User. Dermaself also reserves the right to take legal action to protect its rights and seek compensation for any direct or indirect damages, including any damage to its reputation.
INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS Dermaself informs the User that the Website, as well as all trademarks and distinctive signs used by Dermaself in connection with the offer of the Service and/or Products, is protected by intellectual and industrial property rights and that any type of reproduction, communication, distribution, publication, alteration or transformation, in any form and for any purpose, of the contents of the Website, the trademarks and distinctive signs used by Dermaself (such as, by way of example: the works, images, photographs, drawings, dialogues, presentations, music, sounds, videos, graphics, colors, functionality and design of the Website) is prohibited.
FORCE MAJEURE Dermaself will be legally exempt and not obliged to fulfill, either fully or partially, any obligation towards the User in the event of force majeure events, including (by way of example and not limited to) fires, explosions, natural disasters, wars, riots, lockouts, strikes, any form of government intervention, epidemics and pandemics and resurgences thereof, service interruptions, technical problems that prevent or unreasonably delay the use of the Website, the sudden or prolonged absence of medical personnel operating as part of specialized medical support, the purchase and/or delivery of the Products, shortages of raw materials or any other circumstance beyond the reasonable control of Dermaself. During a force majeure event, Dermaself's obligations are suspended for a period equal to the duration of the force majeure event. If the force majeure event continues for a period exceeding 30 (thirty) days, either party may terminate the Contract affected by the force majeure event with immediate effect by giving written notice to the other party without any compensation being due, other than Dermaself's reimbursement of all amounts paid to Dermaself by the User in relation to the purchased Product or the requested specialist medical support.
PROCESSING OF PERSONAL DATA The User's personal data is processed by Dermaself, as data controller, in accordance with applicable data protection legislation. For further information on Dermaself's processing of personal data, please refer to the Privacy Policy and Cookie Policy.
COMMUNICATIONS Dermaself may send communications to the User via the email address and telephone number provided during registration. Upon request from the User (not a Minor), Dermaself will periodically send the User offers, promotions, surveys, and personalized communications to allow the User to save money or stay up-to-date on all the latest news. CHANGES TO THE CONDITIONS The Terms and Conditions may be subject to changes and updates. Any updates and changes will be regularly posted on the Website, and the date of their online publication is equivalent to their effective date.
APPLICABLE LAW AND JURISDICTION For all Users Contracts concluded between the User and Dermaself are governed by Italian law. For anything not expressly provided for herein, the provisions of current Italian law apply. For non-consumer users Any dispute arising from any agreement resulting from or in connection with the Conditions shall be subject to the exclusive jurisdiction of the Court of Milan. For Consumer Users Any dispute arising from any agreement resulting from or in connection with the Conditions will be subject to the exclusive jurisdiction of the competent court of the place where the consumer resides or is domiciled. For anything not expressly provided for herein, the provisions of the Italian law apply, and in particular the provisions of Section II, Chapter I, Title III, Part III of the Consumer Code.
